TERMS & CONDITIONS + WARRANTY + REBATE AGREEMENT

1. Scope of Work

This agreement applies to the sale, installation, and service of the Costway Model FP10895US-12WH Mini Split System provided by our company (“Contractor”).

2. Equipment Warranty (Manufacturer-Based)

The installed system includes a Limited Five (5) Year Warranty covering:

• Compressor: Five (5) Years 
• All other mechanical and electrical components: Five (5) Years 

Coverage applies to defects in materials and workmanship under normal operating conditions.

3. Labor Warranty (Contractor Provided)

Contractor provides a Five (5) Year Labor Warranty, which includes:

• Labor for repair or replacement of defective components 
• Workmanship related to installation 

4. Included Service Period

• One (1) Year of service is included from installation 
• Includes diagnostics and standard service visits as deemed necessary 

After Year 1:

• A service call/trip fee may apply for on-site visits 
• Labor for covered repairs remains included under the 5-year labor warranty 

5. Rebate & Incentive Programs (California Programs)

Customer acknowledges that this project may involve rebates, incentives, or funding programs administered by utilities or agencies including, but not limited to:

• Los Angeles Department of Water and Power 
• Southern California Edison 
• State of California energy efficiency or electrification programs 

Important Rebate Terms:

• Rebates are NOT guaranteed 
• Approval is subject to: 
  
  • Program availability 
  • Funding status 
  • Property eligibility 
  • Documentation accuracy 
• Contractor does not control approval, processing time, or payment 

Payment Responsibility:

• Customer is fully responsible for the total contract amount, regardless of rebate status 
• Any expected rebate shall not delay or reduce payment owed to Contractor unless explicitly stated in writing 

Assignment of Rebates (Optional Clause – HIGHLY RECOMMENDED):

Customer agrees to assign rebate payments to Contractor when applicable. If rebate is paid directly to Customer, Customer agrees to remit such funds to Contractor within five (5) business days if previously credited toward the project cost.

6. Customer Responsibilities

To maintain warranty and rebate eligibility, Customer agrees to:

• Operate system per manufacturer guidelines 
• Maintain system (including filter cleaning) 
• Provide safe and reasonable access for service 
• Provide accurate information for rebate applications 

7. Exclusions

Warranty does NOT cover:

• Misuse, negligence, or improper operation 
• Lack of maintenance 
• Electrical issues, power surges, or utility-related damage 
• Acts of nature (fire, flood, earthquake, etc.) 
• Unauthorized service or modifications 
• Cosmetic damage or normal wear and tear 
• Damage to refrigerant lines not caused by installation defect 

8. Permits, Compliance & Program Requirements

Where applicable:

• Work will comply with local codes and program requirements 
• Customer agrees to cooperate with inspections, verifications, or documentation required by rebate programs 

Failure to comply may result in rebate disqualification, which remains the Customer’s responsibility.

9. Limitations of Liability

Contractor’s liability is limited to repair or replacement of covered items.

Contractor is not responsible for:

• Indirect or consequential damages 
• Loss of use, income, or business 
• Delays caused by manufacturers, utilities, or rebate programs 

10. Transferability

Warranty is non-transferable and valid only for:

• Original purchaser 
• Original installation address 

11. Service Requests

All service must be requested through Contractor.

• Response times are not guaranteed 
• Emergency or after-hours service may incur additional fees 

12. Acceptance of Terms

By proceeding with installation, payment, or service, Customer agrees to all Terms & Conditions outlined herein.
